Methodological recommendations for the state control in the field of environmental protection considering the new duties of Rosprirodnadzor

According to the Federal Law dated 10.01.2009 №65 “About environmental protection” state environmental control is accomplished by the federal and local authorities. The system of the state environmental control is established by the Russian Government. According to the Rules of the state control implementation in the field of environmental protection (state environmental control) the state control consists of:

a) State control of air protection;

b) State control in the field of waste (except for radioactive waste);

c) State control of protection and use of water objects;

d) State control of geological research, protection and use of natural resources;

e) Land use state control;

f) State control in the field of protection, reproduction and use of animals and their habitats;

g) State control in the field of organization and functioning of protected areas;

h) State control of inland sea and territorial waters of Russian Federation;

i) State environmental control of exceptional economic area of Russian Federation;

j) State environmental control of the continental shelf of Russian Federation;

k) State forest control;

l) State environmental control in the field of protection of the lake Baikal.

The Federal Law dated 26.12.2009 № 294 “About protection of rights of juridical and individual persons during implementation of the state and municipal control” establishes:

1. The system of inspection of juridical and individual persons by the state and municipal control bodies;

2. The system of coordination between the state and municipal control bodies;

3. Rights and charges of the state and municipal control bodies and their officials during inspections;

4. Rights and charges of juridical and individual persons during the state and municipal control, protection of their rights and interests.

Considering features of different types of environmental control and requirements of the Federal law № 294 FCGS “Ecology” has developed projects of methodological recommendations for implementation of the state control:

1. Project of methodological recommendations for implementation of the state control which is accomplished and organized by Rosprirodnadzor state inspectors in the field of air protection;

2. Project of methodological recommendations for implementation of the state control which is accomplished and organized by Rosprirodnadzor state inspectors in the field of waste production and consumption;

3. Project of methodological recommendations for implementation of the state control which is accomplished and organized by Rosprirodnadzor state inspectors in the field of land use;

4. Project of methodological recommendations for implementation of the state control which is accomplished and organized by Rosprirodnadzor state inspectors in the field of protection and use of water objects;

5. Project of methodological recommendations for implementation of the state control which is accomplished and organized by Rosprirodnadzor state inspectors in the field of fulfillment of executive authorities duties in the field of water issues.

These projects of methodological recommendations have a single structure and consist of five sections:

1. General issues;

2. Inspection planning;

3. Preparations for the inspection;

4. Inspection of documents;

5. Field inspection.
